A CONSUMER RIP-OFF IN NEW MEXICO

If you have a mortgage, you've paid for title insurance -- a policy that is supposed to protect your interest in the property should anyone challenge the title claim.

Your title insurance fee entitles you to a professional title search to uncover liens, restrictions, encroachments or encumbrances that could affect the property.

Of course, you would expect the title company that conducted the faulty search to be liable for damages? After all, isn’t that why you bought title insurance in the first place?.

Not in New Mexico. It doesn’t work that way.

A CRUEL JOKE ON THE UNSUSPECTING

In 1999 the Legislature passed a law, NMSA 1978 §59A-30-11(A), that effectively rendered “title insurance” a cruel joke. Today title insurance in New Mexico is nothing more than an industry scam to entrap the unwary – a rip-off that can ruin the dreams of families wishing to buy a home . . . or destroy the investment of an entrepreneur trying to start or expand a business.

Today in New Mexico, the law provides “special immunity” for the insurance industry; it protects an industry that is supposed to protect you.

It’s time to reform the law regulating the title insurance industry in New Mexico.
